Terms of Service
Last updated: 15 August 2026
Welcome to dammetjiesholdings.shop, operated by Dammetjies Holdings. These Terms of Service govern your use of our website and your purchase of products from us. By accessing our website or placing an order, you agree to these Terms of Service. If you do not agree with these terms, please do not use the website. Nothing in these terms excludes or limits any consumer right that cannot lawfully be excluded under South African law.
1. Definitions
In these Terms, “Dammetjies Holdings”, “we”, “us” or “our” means Dammetjies Holdings. “Website” means dammetjiesholdings.shop and any associated pages or services operated by us. “Customer”, “you” or “your” means any person who accesses the Website or purchases products from us. “Products” means the goods offered for sale through the Website.
2. About our products
We make reasonable efforts to ensure that product descriptions, photographs, prices and other information displayed on the Website are accurate and current. However:
- colours and appearance may vary depending on your device;
- packaging may change from time to time;
- product images may be illustrative;
- availability may change without notice; and
- minor variations in natural products may occur.
Nothing in this section limits any statutory requirement that products correspond with their descriptions or meet applicable quality and safety requirements.
3. Product availability
All orders are subject to product availability. If a product becomes unavailable after you place an order, we will notify you as soon as reasonably possible and provide an appropriate remedy, including a refund where applicable. If we are unable to fulfil an order within the agreed period, your statutory rights under applicable law will apply.
4. Prices
All prices displayed on the Website are stated in South African Rand (ZAR), unless otherwise indicated. We reserve the right to correct genuine pricing or typographical errors. If an obvious pricing error occurs and you place an order at an incorrectly displayed price, we will contact you before processing the order where reasonably possible. Any applicable delivery fees will be displayed or communicated before completion of the purchase.
5. Orders
When you place an order through the Website, you are making an offer to purchase the selected Products. An automated order confirmation does not necessarily mean that the order has been accepted or that the Products are available. We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or listing error;
- payment cannot be successfully processed;
- we reasonably suspect fraudulent or unauthorised activity; or
- circumstances outside our reasonable control prevent fulfilment.
If we cancel an order after payment has been received, we will refund the applicable amount in accordance with applicable law.
6. Payment
Payment must be completed using the payment methods made available on the Website. We do not ordinarily have access to your full payment-card details where payment is processed through an external payment provider. You are responsible for ensuring that the payment information supplied by you is accurate and that you are authorised to use the selected payment method.
7. Delivery
We will deliver Products to the delivery address supplied when placing your order. Estimated delivery times may vary depending on your location, product availability, courier capacity and other circumstances. We will provide delivery information where applicable. If a specific delivery period has been agreed, that agreed period will apply.
South African law provides consumer protections concerning delivery, including where a supplier fails to execute an order within the applicable agreed or statutory period. Once an order has been delivered to the address provided by you, you are responsible for ensuring that the Products are appropriately stored and handled in accordance with any instructions provided. This does not limit any rights relating to defects, damage or non-conforming goods that existed before delivery or arose while the goods remained at our risk under applicable law.
8. Incorrect delivery information
You are responsible for providing accurate delivery information. If an order cannot be delivered because the customer supplied an incorrect or incomplete address, additional delivery costs may apply where legally permissible. Please contact us as soon as possible if you realise that your delivery information is incorrect.
9. Returns, refunds and cancellations
Returns, refunds and cancellations are governed by our Returns, Refunds & Cancellation Policy, which forms part of these Terms. Nothing in our returns policy or these Terms limits mandatory consumer rights under South African law.
10. Consumer protection
We operate in accordance with applicable South African consumer-protection legislation. This includes applicable provisions of the Consumer Protection Act 68 of 2008; the Electronic Communications and Transactions Act 25 of 2002; and other applicable laws and regulations. Where a statutory consumer right applies, that right will prevail over any inconsistent provision in these Terms.
11. Food and natural products
Some Products sold through the Website may be natural, agricultural or food products. Natural products may have reasonable variations in colour, texture, taste, consistency, appearance and other characteristics. Such natural variation does not necessarily constitute a defect. Customers must follow any storage, handling and usage instructions supplied with the Products. We do not provide medical, nutritional or therapeutic advice unless expressly stated otherwise. Any information concerning potential characteristics or benefits of a product should not be interpreted as a guarantee that the product will prevent, treat or cure a medical condition.
12. Allergies and dietary requirements
Customers are responsible for reviewing product information and ingredient information provided on the Website or product packaging where applicable. If you have an allergy, intolerance or specific dietary requirement, you should review the applicable product information carefully and contact us before purchasing if you require clarification.
13. Website use
You agree not to:
- use the Website for unlawful purposes;
- attempt to gain unauthorised access to the Website or its systems;
- interfere with the operation or security of the Website;
- introduce malicious software or harmful code;
- use automated systems to scrape or extract Website content without permission;
- impersonate another person or business; or
- submit false, misleading or fraudulent information.
We reserve the right to restrict or terminate access where reasonably necessary to protect the Website, our business or other users.
14. Intellectual property
Unless otherwise indicated, all content on the Website, including logos; branding; photographs; product descriptions; graphics; text; designs; videos; and Website materials is owned by or licensed to Dammetjies Holdings and is protected by applicable intellectual-property laws. You may not reproduce, modify, distribute, sell, publish or commercially exploit our Website content without our prior written permission, except where permitted by law.
15. User reviews and submissions
If you submit a review, photograph, testimonial or other content to us, you confirm that: you have the right to submit that content; it does not unlawfully infringe another person’s rights; it is not fraudulent or misleading; and it does not contain unlawful or harmful material. By submitting content, you grant Dammetjies Holdings a non-exclusive, royalty-free licence to use, reproduce and display that content for legitimate business and marketing purposes, subject to applicable law. We reserve the right to remove content that is unlawful, misleading, offensive, fraudulent or otherwise inappropriate.
16. Website availability
We aim to keep the Website available and functioning reliably, but we do not guarantee uninterrupted access. The Website may occasionally be unavailable due to maintenance, technical problems, updates, hosting issues, cybersecurity incidents or circumstances outside our reasonable control. Nothing in these Terms excludes liability that cannot lawfully be excluded.
17. Third-party services
The Website may rely on third-party services, including payment processors, hosting providers, courier companies, analytics providers and other technology providers. We are not responsible for independent failures of third-party services outside our reasonable control, although we will take reasonable steps to assist where appropriate.
18. Limitation of liability
To the maximum extent permitted by law, Dammetjies Holdings will not be liable for indirect or consequential losses arising from your use of the Website or Products. However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability arising from mandatory consumer-protection rights.
19. Events outside our control
We will not be responsible for delays or failures caused by circumstances reasonably beyond our control, including natural disasters, severe weather, strikes, civil unrest, infrastructure failures, courier disruptions, internet outages, power failures, government action or other force-majeure events. Where such circumstances occur, we will take reasonable steps to minimise disruption and communicate material delays to affected customers.
20. Privacy
We collect and process personal information in accordance with applicable data-protection legislation, including the Protection of Personal Information Act 4 of 2013 (“POPIA”). Please refer to our Privacy Policy for information about how we collect, use, store and protect personal information. POPIA provides rights concerning personal information, including rights relating to access, correction and complaints.
21. Electronic communications
When you use the Website or communicate with us electronically, you consent to receiving electronic communications relating to your orders, account, transactions and other legitimate business matters. Transaction records and electronic communications may be retained as required by applicable law.
22. Changes to these Terms
We may update these Terms from time to time. The latest version will be published on the Website with the relevant “Last updated” date. Changes will not retrospectively remove rights that you have already acquired under applicable law.
23. Complaints
If you have a complaint, please contact us first so that we can attempt to resolve the matter. Email: sales@dammetjiesholdings.co.za. Please provide your order number and a clear description of the issue. We will make reasonable efforts to investigate and resolve complaints promptly.
24. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in accordance with applicable South African law and any applicable consumer-dispute resolution mechanisms.
25. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue to apply.
26. Entire agreement
These Terms, together with the Website’s other policies and any specific terms communicated to you in relation to an order, constitute the terms governing your use of the Website and purchase of Products, subject to any mandatory rights provided by law.
